Family Reunification explained
Family Reunification Visa in the Republic of Cyprus is one of the Immigration pathways available for foreigners who arrive from Third Countries to be reunited with their close family members currently working/residing in Cyprus.
The Cyprus Immigration legislation defines family reunification programs as legal procedures through which foreigners are allowed to arrive and stay in Cyprus with their close family members, with the purpose of preserving the unity of the family. Separation is usually work related, this is where a family member has been relocated to Cyprus or has sought employment in the Republic.
Family reunification is not open to all family members but only to close family members who are part of a “family unit”.
The family member (Sponsor) residing in the Republic must meet the following criteria before an application can commence:
- The family member has stayed lawfully in the Republic for at least 2 years;
- Holds a Residence Permit with a validity of at least 1 year;
- Has reasonable prospects of obtaining the right of permanent residence;
- Receives a minimum annual salary of €24,000, increasing by 20% for the spouse and a further 15% for each dependant child or dependant ascendants (If applicable);
- Employed by a company (Proof of contract of employment required) which has approval to employ Third Country Nationals.
Time frame and criteria for application of Family Reunification
An entry permit is issued after the sponsor has submitted an application to the Civil Registry and Migration Department in Nicosia.
Within 7 days of arrival into the Republic of Cyprus family members must contact the Civil Registration and Migration Department to record their registration at the Aliens Register with the local authorities, according to the Aliens and Immigration Law. The application is submitted and if the conditions are fulfilled then the application is examined, this normally happens within 90 days from the date of submission.
Family Reunification can also be submitted in conjunction with the application of the sponsor with processing undertaken at the same time.
Initially the family reunification document (First Residence Visa) will be issued to each individual member for a term of one year, these can be renewed each year but cannot exceed the family members (Sponsors) length of stay in the Republic, usually the length of the Visa will match that of the sponsor.
Family members that are eligible to apply for reunification must meet the following criteria:
- Sponsors spouse must be over the age of 21 and that the marriage was conducted at least 1 year from the date of submission;
- The families children or adopted minors can relocate to Cyprus if they are under 18 years of age and not married at the time of application, either partner must have custody with the children dependant on either of the parents;
- The spouse must have a minimum age of 21 years old.
Application Process and documentation BEFORE arrival
As with any application there are necessary documents that need to be submitted prior to the arrival of family members into the Republic of Cyprus. The list is extensive but Rideo Group have the experience and knowledge to guide you through this complex process:
- Accompanying documents for the type of application for each family member;
- Copy of valid Passport with at least 9 months expiration period;
- Certified copy of the Marriage Certificate showing at least 1 years validity;
- Certified copy of Birth Certificate for each under 18 year old child;
- Court confirmation for each adopted child of the sponsor and/or spouse;
- Original Criminal Record for spouse and children over the age of 16 years;
- Original medical examination results showing the following ailments as clear, these must be validated by a specialist doctor;
- AIDS;
- Hepatitis B and C;
- Syphilis;
- Tuberculosis.
- Rental agreement or Title Deeds of property;
- Tax/VAT returns for the sponsor showing the previous year’s income;
- Sponsor’s Income Declaration for sources other than employment;
- Certificate of Contributions to the Social Insurance Fund, from the Social Insurance Services;
- Bank account statements;
- Utility bills;
- Phone;
- Water;
- Electricity.
- Original letter of guarantee issued by a Cypriot Bank with a validity of 10 years covering repatriation expenses.
Application Process and documentation AFTER arrival
- Copy of family members Passports or other travel documents, these need to show the latest entry into the Republic and any Visas (If applicable);
- Original family members entry permit (M70);
- Childs certificate of School enrolment (If applicable);
- Original medical examination results showing the following ailments as clear, these must be validated by a specialist doctor;
- AIDS;
- Hepatitis B and C;
- Syphilis;
- Tuberculosis.
- Valid health insurance policy for the sponsor and each family member, this must cover inpatient or outpatient care, including transportation of Corpse OR Registration Certificate in the General Healthcare System (GHS – GESY) and private insurance for transportation of Corpse.
All documents submitted must be translated into Greek or English apostille and certified where required.
Access to employment for Spouses
Spouses have the same direct access and terms and conditions to employment as the sponsor, these include free access to the labour market and includes self-employment.
Spouses of employees of a company of foreign interests have free access to remunerated employment in a Cypriot Company, provided that the requirements of the migration legislation for the issuance of a single permit are met.
